McAllister’s Decision On The Assembly Maps – Is Out

May 11, 2022

BATH – In a groundbreaking case that will determine the next decade of elections in our state, a motion has been made to deny intervention.

Steuben County Judge Patrick McAllister has made a motion to deny intervention from Gavin Wax of the NYC Republicans, New York City Democrat activist Gary Greenburg, and the five petitioners; Benjamin Carlisle, Emin Egriu, Michael Rakebrandt, Jonathon Howe, and Howard Rabin on May 11. So it appears that unless the Democrats and/or Republicans appeal this case and win, the state assembly maps will remain the same.

After careful determination and viewing all documents and testimonies argued in court on May 10 it is determined that this action is untimely. The court is aware of the frustration potential candidates face in the redistricting of the maps. The court is working with the Board of Elections to create a possible roadmap for an August 23 primary. The court is seeking all options, but it is dependent on new Congressional and Senate maps being drawn up by May 20.

For reasons stated by the court it would be extremely burdensome to all parties involved to allow intervention at this untimely manner. Nothing in this motion is meant to prevent both parties from seeking separate action to challenge the assembly maps.

The court is mindful that any action to change the assembly districts would impact several other elected officials. It is the courts determination that any change would make it impossible to meet the deadline for the upcoming election.

It is uncertain if this will be appealed.

Congressman Tom Reed Has Resigned, Effective Immediately

May 10, 2022

WASHINGTON DC – Congressman Reed has resigned from Congress, effective today, May 10, 2022. Our office will continue to serve the people of New York’s 23rd District through the end of the year or until a new representative is elected and sworn in.
Background note: Please see below for a copy of Congressman Reed’s remarks on the floor today. Tom will be joining Charlie Black at the Prime Policy Group, Washington, DC.

Madam Speaker,
After almost 12 years in Congress, today is my last day. It has been an honor to serve with you all from both parties. I love this institution as it still exemplifies what is best about our government, we are the People’s house. While I am proud that we put people before politics, there is much more to do. I am leaving to continue that work and hope to have a greater impact on our Country.
I believe the current focus on extremism demands us to heed the words of Abraham Lincoln uttered years ago as we face a similar threat to our existence today— “a house divided cannot stand!” But I add— “a house United will not fail.” It is time for petty political posturing to end. Leadership must emerge And in God I trust. His divine protection will extend again if only we acknowledge and accept His love and the divine spark that exists in each of us as citizens of our great nation.
I want to thank my family, who without their love and support I am nothing. I also thank the people who have worked for us and helped so many. I am grateful.
My most profound appreciation is for the people of Western New York. Thank you for giving a country lawyer, the youngest of twelve, raised by a single mother whose father passed away when he was only two, the honor of representing you at the highest level. Only in America can such a dream come true.
So, I humbly bid farewell and submit my resignation as a Member of the House. I wish you all — Godspeed!

Judge McAllister Will Announce His Decision Tomorrow

May 10, 2022
By Jasmine Willis

BATH, NY – In closing statements Heather McKay who represents Gov. Hochul asked the judge not listen to all the “conspiracy theories” made today. Attorney Aaron Foldenauer who represents Gavin Wax said all candidates are in the same boat and the maps need to be redrawn and there is plenty of time to do so.
The ballots are not finalized and there is still time to get it all done.

Attorney Jim Walden who represents Democrat activist Gary Greenberg said three points need to be made. Wait until July 8 to send the ballots overseas to military personnel. Change primaries from June 28 to Aug. 23 to give time to redraw the maps. Change all the races to make a fair constitutional map in all three categories; Congress, Senate and Assembly.

Attorney George Winner claims that the accusations made against them about a “deal” is outrageous and untrue. There is not proof this back room deal happened. He was offended by the accusations made against them. He claims all three maps are fair and a success for all candidates involved. “In closing legal counsel has determined that what has happened is unconstitutional and will set a presidents for all future elections in our state”. Winner said.

Judge McAllister has reserved his right to make a decision involving redrawing the assembly maps in written form tomorrow.

What’s Going On In Judge Pat McAllister’s Court Today

May 10 2022
By Jasmine Willis

BATH, NY – Things are under way in Judge Pat McAllister’s courtroom in Bath, for the proceedings in the case of the New York City Young Republicans Club’s lawsuit against Governor Kathy Hochul’s approval of the state assembly maps.

Discussion has been going on about the state assembly’s legislative maps and the New York State primary. Judge McAllister has expressed concerns that there might not be enough time to change the assembly maps. McAllister has also said he has concerns that there will be an appeal after his ruling: an appeal which could possibly delay the primary date, even more.

Attorney George Winners says that Gary Greenberg had plenty of time in feb to fight this but waited until may and that if this goes through we wont have enoug time for elections.

Attorneys Foldenauer and Walden are represting Greenberg. They maintain that all the candidates with no voice to change the maps and make the primes on August 23, instead of a June primary.

Foldenauer and Walden argue that there was a back room deal made by both parties and it doesnt give the voters a voice, they also maintain that there could be possible future rigged votes and that this will make NYS elections into a joke.

Beth Mack Moore, of Canisteo

With sadness, the family of Beth Mack Moore announces her passing on Wednesday, May 4, 2022 at Taylor Health Center in Bath, NY. Beth was born at Bethesda Hospital in Hornell, NY on September 21, 1936, the only child of Edith (Gee) Mack and Carl Bryan Mack. She grew up on Madison Avenue in Hornell and was a 1954 graduate of Hornell High School. At the age of 9, her dad was tragically taken from her in a drowning accident at Loon Lake. Beth’s mom was a huge presence in her life until her death in 2010 at the age of 104!

A trailblazer as a working mother and female broadcaster in the 1960’s, Beth embarked on a decades-long career in local radio, beginning as a secretary at WWHG Radio in Hornell and WFSR Radio in Bath. She took time away to raise her children, then, seeking a way to help the Hornell community during the flood of 1972, she volunteered her services at WLEA radio, tracking and verifying rosters at area evacuation sites as well as updating injury and casualty developments 24/7 through this crisis. She was asked to stay on at WLEA and for the next 22 years, enjoyed a remarkable career as a local news reporter, and as an account clerk serving the Hornell, Bath and Wellsville areas. Beginning in the late 1970s’s she found her true stride as the host of the hugely popular 9 AM “The Beth Moore Show.” Always upbeat and personable, to this day listeners recall her informative conversations with local business people, sharing weekly business specials, recipes, family stories, and always, her ongoing experiences as Willie Nelson’s biggest fan. Beth treated her guests and listeners like friends bonding over a cup of coffee and conversation, and shared so much that when revealing something to her, her family would remark that it was “off the record.” Local business owners raved at the outreach their radio appearances had on business while listeners loved getting to know them in new ways. Beth continued her work in local media, as a salesperson for the Hornell-Canisteo PennySaver for several years, then returned with “The Beth Moore Show, this time broadcast on Hornell’s WHHO Radio. In her later years, she fought valiantly against the ravages of vascular dementia.

Surviving are her daughters Lisa (Terry) Sanford of Canisteo, Jodi-Lynn Stephens (Donna Saltsman) of Bath and Marcia Stephens of Syracuse. She is also survived by her much-loved granddaughter, Katharine Sanford of London, England, special cousins Patricia Davison (Richard) of Canaseraga and Bobbie (Elias) Lopez of Pasadena, California, step-sister Dorothy Ryan of Bath, step-children Karen Lowry of South Carolina and Craig Hammond of Hornell, as well as her former husband John Moore.

A celebration of life service will be announced through the Brown and Powers Funeral Home and held at a later date. Until that time, please share your fond memories of Beth with a remembrance at www.brownandpowersfuneralhomes.com, or on Facebook @brownpowersfh. Memorials in Beth’s memory are welcome to support the Hornell Area Humane Society or the Hornell YMCA.

Beth’s family thanks all who showed friendship and supported Beth until her passing, with a special thank you to the caring staff at Taylor Health Center.
