DWI In Allegany County, Driver Charged With Manslaughter When Accident Victim Dies At Jones Memorial

SCIO, NY – State Troopers Police report that Todd Gardner, 43 of Scio, has been charged with 2nd degree Manslaughter and DWI. According to State Police, at about 12:30 this morning, Troopers responded to County Route 18 in the Town of Scio for report about a pedestrian struck by a vehicle. State Police say that Todd Gardner was traveling on County Route 18 in a 1991 Chevrolet Camaro, and struck Douglas Brauen, 37 of Wellsville. State Police say that Brauen sustained injuries, but was alert and responsive, and was taken to Jones Memorial Hospital in Wellsville for possible leg fractures. Officials say that during his hospital treatment, Brauen had a heart attack and died.

The investigation revealed that Gardner was under the influence and placed under arrest. Garner was transported to SP Amity and submitted to a breath test resulting in a .11 percent BAC. Gardner was remanded to Allegany County Jail on $5,000 bail.

This is still an ongoing criminal investigation.
