Gov Hochul Names New Law After Vietnam War Hero

July 4, 2023

Governor Kathy Hochul has signed the “Sergeant Gary Beikirch Memorial Act,” legislation which expands eligibility for special license plates issued to Congressional Medal of Honor recipients to include their spouses. Legislation (A.3305-B/ S.5521-A) will allow spouses of Congressional Medal of Honor recipients to apply for distinctive license plates and transfer the license plates of deceased recipients to surviving spouses. The law will ensure that spouses of those who have received Congressional Medals of Honor can commemorate the service and sacrifice of the brave men and women they married.

“The brave men and women who have received Congressional Medals of Honor have gone above and beyond the call of duty in sacrifice to their nation, and they deserve to be properly honored,” Governor Hochul said. “By extending the opportunity to display these special license plates to the family members of honorees, we are taking yet another step to show our appreciation for the valor, heroism, and selflessness of our military members.”

State Senator Jeremy Cooney said, “Medal of Honor recipients are amongst the greatest heroes in our country, and it is important their families be permitted to showcase their pride. I carried this bill in honor of local Medal of Honor recipient Sergeant Gary Beikirch in the hopes that his family will be allowed to display their pride, and keep his memory alive. I thank Governor Hochul and my colleagues in the legislature for their support of this bill.”

Assemblymember Sarah Clark said, “The Congressional Medal of Honor is our nation’s highest military honor. Sergeant Gary Beikirch received the Congressional Medal of Honor in 1973 for coming to the aid of wounded American service members while wounded himself in Vietnam. Sergeant Beikirch proudly displayed the distinctive Congressional Medal of Honor license plate, among many other honors. The Sergeant Gary Beikirch Memorial Act will allow Mrs. Beikirch and all Medal of Honor spouses to display this distinctive plate, preserving the legacy of our New York heroes while also honoring the important contributions made by our military spouses and families. Thank you to the Department of Motor Vehicles for working with my team on this legislation and to Governor Hochul for her support.”

Legislation (A.3305-B/S.5521-A) will allow spouses of Congressional Medal of Honor recipients to apply for distinctive license plates and transfer the license plates of deceased recipients to surviving spouses. The change will also help ensure that veterans who do not drive or whose cars are not registered under their name are still able to proudly display and commemorate their veteran service and military honors.

Additionally, this legislation is named in honor of Sergeant Gary Beikirch, an Army veteran who received the Congressional Medal of Honor for his exemplary service during the Vietnam War in 1970. This law will allow Sergeant Beikirch’s wife and all Medal of Honor spouses to display these distinctive plates, helping to preserve the legacy of our New York’s military heroes. Beirkirch went out of his way to save a fellow solider in Vietnam, after Beirkirch was himself wounded in action. Only after having saved another soldier, did Sgt. Beirkirch allow any medical treatment for his own injuries.

Senator Gillibrand: Ensuring Justice for Victims of Terrorism Act

July 4, 2023

Today, U.S. Senator Kirsten Gillibrand announced her support for the Ensuring Justice for Victims of Terrorism Act, bipartisan legislation that would close loopholes in the Justice Against Sponsors of Terrorism Act (JASTA). The bill would make technical corrections to JASTA that would enable families of victims of terrorism to sue foreign state actors for aiding and abetting terrorism.

“9/11 was one of the darkest days in U.S. history and it is essential that the victims’ families can seek justice against those who enabled these horrific attacks,” said Senator Gillibrand. “The bipartisan Ensuring Justice for Victims of Terrorism Act will make important changes to existing law to ensure the families of U.S. victims of terrorism can bring legal action against foreign sponsors of terrorism. I am grateful this bill has strong bipartisan support in both the House and Senate and I will work with my colleagues to get it swiftly passed and signed into law.”

The Ensuring Justice for Victims of Terrorism Act makes technical corrections to the Justice Against Sponsors of Terrorism Act (JASTA) that would:

Clarify that injured plaintiffs can sue foreign state defendants for aiding and abetting terrorism and ensure that liability may be asserted as to any person or entity that aids or abets terrorism;
Ensure that plaintiffs, if they obtain a judgment on a JASTA claim, can collect their judgment; and
Clarify that all U.S. citizens injured in their person, business, or property may recover under JASTA.

The bill is led by Senators John Cornyn (R-TX) and Robert Menendez (D-NJ). In addition to Senator Gillibrand, this bill is cosponsored by Majority Leader Charles Schumer (D-NY), Senators Chuck Grassley (R-IA), Lindsey Graham (R-SC), Mike Lee (R-UT), Richard Blumenthal (D-CT), Dianne Feinstein (D-CA), Marco Rubio (R-FL), Cory Booker (D-NJ), Thom Tillis (R-NC), Marsha Blackburn (R-TN), Sheldon Whitehouse (D-RI), Rick Scott (R-FL), Mazie Hirono (D-HI), Joni Ernst (R-IA), Peter Welch (D-VT), Pete Ricketts (R-NE), and Ed Markey (D-MA).

JASTA was enacted by Congress in 2016. The bill amended the Foreign Sovereign Immunities Act so that foreign sponsors of terrorism cannot invoke “sovereign immunity” in cases arising from a terrorist attack that kills an American on American soil. JASTA also amended the Anti-Terrorism Act so that civil suits against foreign sponsors of terrorism can be heard in U.S. courts when their conduct contributes to an attack that kills an American.
