In November of 2022, then, 26 year old Robert Taft of Hornell was charged by Hornell Police for allegedly assaulting and allegedly shaking a baby. Steuben County DA Brooks Baker says, yesterday in Steuben County Court, Taft’s attorney, brought in two expert witnesses, one of them, a well known HBO doctor, Dr. Michael Baden, to testify against the idea that shaking a baby can lead to brain damage.
Baker also says, the prosecution also had two expert witnesses, doctors from Rochester, who testified that Shaken Baby Syndrome is a legitimate medical condition.
The judge will have to decide on whether the testimony from the two Rochester doctors will be admissible in Steuben County Court. District Attorney Brooks Baker sindicates that this could be a precedent setting case.
The judge is Supreme Court Judge Jason Cook.
