Hornell Bus Stop Smoking/Vaping Ban Updated

September 8, 2020

From Mayor John Buckley:

“This year more than ever, health and well being are on the forefront our minds.  Every September as students, parents, and teachers prepare for the start of a new school year, we remind residents of the local ordinance prohibiting smoking and vaping at school bus stops in the City of Hornell.  As you are waiting with or for your child at a school bus stop, or simply passing by, please be mindful of the children and refrain from vaping or smoking.  The children of our community deserve the safest and best possible environment.”

Whereas, Section 210-10 of the Codes and Ordinances of the City of Hornell is hereby amended to read as follows:

  • Smoking, vaping and all other tobacco use is prohibited within thirty (30) feet of any and all school bus stops within the City of Hornell while students are present waiting to enter a school bus or discharging from a school bus.
  • For the purposes of this section, a school bus stop shall be defined as any location within the City of Hornell where a school bus stops either to pick up or discharge students going to or coming from school and/or school activities.  Vaping shall be defined as any act whereby you inhale and exhale the vapor produced by an electronic cigarette or similar device whereby the electronic cigarette heats up and vaporizes either a liquid or solid.
  • A violation of this section shall carry a fine of not less than $50.00 and no more than $250.00 for each offense.
